Terms of Service
1. Service provider
The Markular platform is developed and operated by Base 12 AS, company registration number 930 002 615, with registered address Nedre Banegate 41, 4014 Stavanger, Norway.
2. Acceptance of terms
By creating an account or using the Markular platform, you accept these terms of service. If you do not agree to the terms, please do not use the service.
3. Service description
Markular is a cloud-based platform for workforce management, rotation planning, competency management and time registration. The service is delivered as a subscription-based SaaS (Software as a Service) solution.
4. User account
You are responsible for keeping your login credentials confidential. Each user account is personal and must not be shared with others. You are responsible for all activity that occurs under your account.
Base 12 reserves the right to deactivate accounts that violate these terms.
5. Data processing
Our processing of personal data is described in our privacy policy. By using the service, you consent to data processing in accordance with the privacy policy.
Customer data uploaded to the platform remains the property of the customer. Base 12 processes such data solely to deliver the service.
6. Availability
We strive for high uptime and availability, but do not guarantee uninterrupted operation. Planned maintenance will be communicated in reasonable time. Base 12 is not liable for losses resulting from temporary unavailability.
7. Intellectual property
All intellectual property related to the Markular platform, including software, design, logos and documentation, belongs to Base 12 AS. Users are granted a limited, non-exclusive licence to use the platform in accordance with their subscription agreement.
8. Limitation of liability
Base 12 is not liable for indirect losses, consequential damages, lost revenue or lost data beyond what is required by mandatory law. Our total liability is limited to the amount paid by the customer for the service in the preceding 12 months.
9. Changes to terms
We may update these terms from time to time. Material changes will be communicated via email or through the platform. Continued use of the service after changes have been communicated constitutes acceptance of the updated terms.
10. Governing law and jurisdiction
These terms are governed by Norwegian law. Any disputes that cannot be resolved amicably shall be settled by the Stavanger District Court as the legal venue.
